ACCEPTABLE USE POLICY (AUP)

This Acceptable Use Policy ("AUP") governs your use of the Services and
is incorporated by reference into 42U Networks L.L.C.'s ("42U Networks")
Terms of Service. Unless otherwise stated, defined terms in this AUP have
the meanings provided in the Terms of Service. 42U Networks may modify this
AUP at any time without notice.
The Services provided by 42U Networks may only be used for lawful purposes.
You agree to comply with all applicable laws, rules, and regulations
concerning your use of the Services. 42U Networks reserves the right to
refuse service to anyone. Any material that, in our judgment, violates this
AUP in any manner may be removed from our servers (or otherwise disabled),
with or without notice, and with no refund being issued. Failure to respond
to an email from our abuse department within the specified time in our email
to you may result in the suspension or termination of the Services.
You are responsible for the activities of your agents, representatives, and
end-users ("Users"), and they will abide by this AUP. The Services shall be
used solely for legitimate business and commercial purposes. You shall not
use the Services for activities which, in 42U Networks' sole discretion,
may be illegal, offensive, abusive, or in a manner that interferes with or
adversely affects the Services or use of the Services (including deliberate
attempts to overload a system and broadcast attacks) or that would expose
42U Networks to criminal or civil liability.

1. PROHIBITED USES & INTELLECTUAL PROPERTY

INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS:
Use of the Services to infringe upon another party's intellectual property
rights is prohibited. This includes, but is not limited to, the unauthorized
copying or distribution of movies, music, books, photographs, software/warez,
or any other copyrighted work. Selling or offering to sell any counterfeit
merchandise will result in the immediate termination of your account. Any
account found to be infringing on the intellectual property rights of others
will be expeditiously removed, or access to the material will be disabled.
Any account that is in repeated violation of this prohibition will be
suspended or terminated.
If you believe that your intellectual property rights are being infringed
upon, please get in touch with us. For copyright infringement claims,
42U Networks follows the Digital Millennium Copyright Act ("DMCA") notice
and takedown procedures.

2. EMAIL & PORT 25 POLICY
----------------------------------------------------------------------
This port is mainly used to send email. With the volume of abusive spam
on the internet daily, 42U Networks takes email spam seriously. We require
users to open a ticket to provide more information on their plans and setup
before the port 25 restriction is removed (this only applies to VPS hosting;
bare metal and colocation do not have these restrictions by default).
If your IP appears on a blocklist once, we will delist it for you. For any
additional blocklist incident, you will be responsible for a $20 fee to
delist the IP. This is handled on a case-by-case basis and will be evaluated
by staff. HELO/EHLO abuse may cause IPs to be blacklisted and is deemed
abusive. We do not allow HELO/EHLO abuse or mass unauthorized connection
attempts from our IP space. Ports will be disabled immediately following
abusive email behavior. Alternatively, we may permanently restrict your VPS
to block email ports with or without notice.
Should our team determine that you represent a high-risk profile, we may
ask for a $15 deposit upon opening email ports (this deposit will not be
returned if we identify email spam originating from your server with us).
This deposit is intended to deter malicious users from damaging our IP
reputation.

3. UNACCEPTABLE MATERIAL

ZERO TOLERANCE ADULT CONTENT POLICY:
42U Networks has a zero-tolerance policy in effect for adult content. We do
not allow any content considered "adult material" on our servers. This
includes any media containing nudity, partial nudity, or anything else of
an adult nature determined in 42U Networks' sole discretion. This does not
apply to fictional artistic nudity. Violators of this policy will be
immediately terminated without a refund.
ADDITIONAL PROHIBITED CONTENT:
Unacceptable material on our servers includes, without limitation:
- Topsites
- Commercial VPN hosting
- Any website related to Cannabis or CBD without prior proof of appropriate permit(s)
- IRC Scripts/Bots
- Proxy Scripts/Anonymizers
- AutoSurf/PTC/PTS/PPC sites
- IP Scanners
- Bruteforce Programs/Scripts/Applications
- Mail Bombers/Spam Scripts
- File Dump/Mirror Scripts (similar to Rapidshare)
- Sale of any controlled substance without prior proof of appropriate permit(s)
- Lottery/Gambling Sites without prior proof of appropriate permit(s)
- Hacker-focused sites/archives/programs
- Sites promoting illegal activities or hate speech
- Forums and websites that distribute or link to warez/pirated/illegal content
- Fraudulent Sites (including, but not limited to, sites listed at aa419.org & escrow-fraud.com)
- Mailer Pro
- Broadcast or Streaming of Live Sporting Events (UFC, NASCAR, FIFA, NFL, MLB, NBA, WWE, etc.)
- Tell-A-Friend Scripts
- Bitcoin or other cryptocurrency miners (unless prior written permission was granted)
- PayDay Loan Sites (including any site related to PayDay loans, PayDay loan lead generation, etc.)
- Hacking, phishing, spamming, scamming, identity theft, fraud, forgery, deception, virus or malware distribution, network attacks, and interference with any other user's use of the Services
- The unauthorized access, monitoring, collection, or use of data, systems, or networks
- Transmitting, distributing, or storing illegal or fraudulent information or material, or material that infringes or otherwise violates any privacy, intellectual property, publicity, or other personal rights
- Web scrapers (applies strictly to web hosting and Discord bot hosting environments)
- Excessive email HELO/EHLO with no legitimate operational reason
In addition, you and your Users must comply with all applicable laws, rules,
and regulations related to your use of the Services, specifically including
data protection and privacy laws and laws relating to unsolicited commercial
electronic messages.
CHILD SEXUAL ABUSE MATERIAL (CSAM) PROHIBITED:
Content that is potentially harmful to minors, as determined in 42U Networks'
sole discretion, is strictly forbidden, including but not limited to child
sexual abuse material, child sexual exploitation material, or content
perceived as child pornography. Any website or account found to host, link
to, or transmit such material will be suspended immediately without notice
and reported to relevant law enforcement agencies.
OTHER PROHIBITED CONTENT:
We reserve the right to refuse service to anyone. Any material that, in our
judgment, is obscene, threatening, illegal, or violates our Terms of Service
or this AUP in any manner may be removed from our servers (or otherwise
disabled), with or without notice.

4. ZERO TOLERANCE SPAM POLICY

We take a zero-tolerance stance against sending unsolicited emails, bulk
emailing, and spam. "Safe lists," purchased lists, and the selling of lists
will be treated as spam. We may terminate the account of any User who sends
out spam with or without notice.
Any User account that results in our IP space being blacklisted may be
immediately suspended and terminated with or without notice.
42U Networks reserves the right to require changes or disable, as necessary,
any website, account, database, or other component that does not comply with
our policies, or to make any such modifications in an emergency that we deem
necessary at our sole discretion.
42U Networks reserves the right to charge the account holder used to send
any unsolicited email a cleanup fee or any charges incurred for blacklist
removal at our sole discretion.

5. RESOURCE LIMITATIONS (SHARED CPU)

VPS plans with shared CPUs may not use more than 50% CPU for longer than
15 minutes continuously. This excessive load can degrade performance for
other users on the physical host machine. We reserve the right to throttle
or limit your CPU usage with or without notice if prolonged high utilization
is detected.

6. DEFAMATION POLICY

Websites hosted on 42U Networks' servers in the U.S. are regulated by U.S.
law. Accordingly, under Section 230(c) of the Communications Decency Act,
42U Networks' policy is not to remove allegedly defamatory material from
websites hosted on our servers unless the material has been determined to
be defamatory by a court of competent jurisdiction, as evidenced by an
official court order.
As a hosting provider, 42U Networks is not a publisher of User content,
and we are not in a position to investigate the veracity of individual
defamation claims. We rely on the legal system and the courts to determine
whether material is defamatory. In any case in which a court order indicates
that material is defamatory, libelous, or slanderous, we will restrict
access to the material. Similarly, if a U.S. court has placed an injunction
against specified content or material being made available, we will comply
and remove or restrict access to the material in question.

7. COMPANY RIGHTS AND DISCLAIMER

42U NETWORKS L.L.C.'S RIGHTS:
42U Networks reserves the right at all times to investigate any actual,
suspected, or alleged violations of this AUP. You shall reasonably cooperate
with 42U Networks in investigating and correcting any actual or alleged breach
of this AUP by yourself or any User. 42U Networks further reserves the right
to cooperate with legal authorities and third parties in investigating any
alleged violations of this AUP, including disclosing the identity of any
User that 42U Networks believes is responsible for such violation. 42U Networks
may implement technical mechanisms to prevent AUP violations.
Nothing in this AUP shall limit 42U Networks L.L.C.'s rights and remedies
available at law or in equity.
DISCLAIMER:
42U Networks is under no duty to monitor any user's activities, and
42U Networks disclaims any responsibility for any User's misuse of the
Services. 42U Networks has no responsibility for any User or other
third-party material or information created, stored, maintained, transmitted,
or accessible on or through the Services. It is not obligated to monitor or
exercise editorial control over such material. If 42U Networks becomes aware
that any such material violates this AUP or exposes 42U Networks to civil
or criminal liability, 42U Networks may, but is not required to, block access
to such material. Unless otherwise stated in this AUP, 42U Networks disclaims
any obligation to anyone who has not entered into a service agreement with
42U Networks.

8. AUP VIOLATIONS & REPORTING

Your Services may be terminated with or without notice upon violating this
AUP. Refunds are not issued for any AUP violations. If applicable, violations
will be reported to the appropriate law enforcement agency.
A failure to respond to an email from our abuse department within forty-eight
(48) hours, or as otherwise specified in the abuse notice, may result in the
immediate suspension or termination of your Services. All abuse issues must
be handled via trouble ticket/email, and you will receive a response within
forty-eight (48) hours.
If you have discovered a violation of our AUP, please contact our abuse
department via the customer support portal or abuse contact email.
